This website, accessible at www.dwavocat.com (hereafter, the “Site”) is proposed exclusively to provide information on the practice areas of Deleporte Wentz Avocat. The information available on this Site may not be considered as legal advice, canvassing, soliciting or advertising.
By accessing and using this Site, you are accepting these terms and conditions of use without reserves. We reserve the right to amend these terms and conditions at any time without prior notice. You are invited to consult this user agreement on a regular basis.
The contents of this Site, i.e. its structure, its texts, the meta-tags as well as the images and graphic elements are the exclusive property of Deleporte Wentz Avocat. These elements are protected by the French Code of intellectual property and by any other national or international intellectual property laws. You are authorized to represent the Site web pages on your screen for temporary consultation only. Any copying, diffusion or use of all or part of the Site contents without the prior express consent of Deleporte Wentz Avocat is prohibited and would constitute copyright infringement punished by articles L335-2 et seq. of the French Code of intellectual property.
This Site may include hypertext links directed towards third party websites. Deleporte Wentz Avocat may not be held liable for any direct or indirect damages which may result from the use of, or relying upon any type of content, data or information accessible from hypertext links published on this Site. Deleporte Wentz Avocat may not be held liable for any direct or indirect damages which may result from the use of information contained in downloadable files accessible on these websites from the hypertext links published on this Site.
These terms regarding personal data protection shall be effective from 25th May 2018, in compliance with the General data protection regulation n°2016/679 (GDPR).
4.1 Registration. You may freely consult this Site. You may also subscribe to our free newsletter or contact us through our online contact form.
4.2 Data collected. Pursuant to the GDPR and in application of the data minimisation principle, we only collect the data which is strictly necessary for the use and operation of the Site, and where applicable, to send our newsletter and to respond to contact requests, to process your file and provide legal advice and for contacts with our suppliers.
The personal data collected are as follows: last name, first name, position, company name, email address, telephone number. For each field, the contact form shows whether the data is mandatory or optional. You may also provide personal data about your file through the contact form.
If you are a client of Deleporte Wentz Avocat, additional personal data may be collected to manage your case(s).
4.3 Purpose of the data processing. Your personal data are processed for the main following purposes :
- responding to a contact request
- processing your file(s)
- sending newsletters
- accounting and invoicing
4.4 Data recipent. The personal data are collected by Deleporte Wentz Avocat. The recipients of your personal data are the attorneys and associates of the Firm to allow them to provide their service, and where applicable law courts and administrative services.
You acknowledge and agree that your data may be transferred to sub-contractors providing the service. These sub-contractors can be attorneys to process your case or our technical hosting provider for the storage of the data. The technical hosting provider is located in France or in the European Union and is also subject to the GDPR.
4.5 Cookies. Our website currently does not use cookies. However, we may use cookies in the future. If this is the case, we will update this section of the user agreement.
You are notified that during your visits on the Site, a “cookie” may be automatically installed on your hard disk. Cookies are data which do not permit to identify you but are used to save your navigation information on the Site. Your browser setting may notify the presence of cookies and allow you to disable them, as described (in French) on the CNIL web site, accessible at: www.cnil.fr (Gestion des cookies), or at www.allaboutcookies.org. By disabling cookies, certain Site functionalities may no longer be accessible.
4.6 Security. The Firm and our hosting provider have implemented appropriate measures to insure the security of your data through physical and logical security measures. However, we cannot assure that your messages and other personal data will not be intercepted or disclosed by a third party.
4.7 Personal data storage period. The Firm shall keep your data for the period necessary for the processing for which they were collected, including to comply with legal, accounting or tax requirements. The Firm also keeps certain types of data which may be necessary in case of future claims or disputes, up until the end of the period legally authorized or until the end of the legal proceedings.
Your data is stored during the time of data processing plus 5 years. Accounting data is stored for 10 years from the date of closure of the accounting year. Regarding the law against money laundering and the financing of terrorism, the data is stored for 5 years after the end of the relations with the Firm. Prospects data is stored for 3 years from the date of last contact with the Firm. The data is deleted at the end of the storage period.
4.8 Your rights on the data collected
– Right of access and rectification : you have the right to access and to correct your personal data by sending an email to contact@dwavocat.com or by postal mail for the attention of Deleporte Wentz Avocat, 5 rue Tronchet - 75008 Paris - France.
– Account closure and data deletion : You can ask for your personal data to be deleted by sending your request by postal mail or email at the addresses mentioned above. We will then delete your data. However, we reserve the right to keep certain types of data subject to the conditions and limitations mentioned in the previous article.
If in your opinion the Firm breached its obligations regarding your personal data, you may file a claim with CNIL, 3 place de Fontenoy - 75007 Paris.
4.9 Data controller. The data controller is Deleporte Wentz Avocat SELARL, registered with the Paris trade registry under number 501 115 075, located 5 rue Tronchet - 75008 Paris - France.
If you are a client-consumer: in case of a claim regarding these terms or the services provided by the Firm, and after attempting to resolve the dispute amicably with the Firm, you are hereby notified that you may use a mediation service or any other type of alternative dispute resolution. You may refer the matter to the médiateur de la consommation de la profession d’avocat (https://mediateur-consommation-avocat.fr/) 180, boulevard Haussmann - 75008 Paris.

The mediator may be contacted by email at mediateur@mediateur-consommation-avocat.fr, by postal mail at the address above or by filling the online form accessible at https://mediateur-consommation-avocat.fr/contacter-le-mediateur/.
You are notified that clearly unfounded or abusive claims or claims that were previously addressed or that are currently being processed by another mediator or by a law court cannot be submitted to the mediator. Claims filed with the mediator more than a year after sending a written claim to the Firm, claims that fall outside the scope of competence of the mediator or claims that you cannot justify having first attempted to resolve directly with the Firm in writing cannot be processed by the mediator.
You may also submit your claim to the dispute resolution platform proposed by the European Commission at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&ing=FR The European Commission will then transfer your claim to the competent national mediators.
The Site is governed by French law.
